The moment you use the name of your band for shows
The moment you use the name of your band for shows or on cds you actually own a “common law” trademark in it. However, common law rights are limited (they may only cover geographic locations where your band actually performed) and you will need a Federal trademark registration to gain additional and important rights to the mark.
